Clean Break & Financial Order

Clean Break & Financial Order

Separation

At separation,  it can be hard to envisage how to see the future. Therefore as a result it is also difficult to establish a financial settlement which is fair and provides a clean break.

Separating  or divorcing and can often take several years to emotionally deal with the loss of the family unit.  Another key point is the reality of setting up a new life, paying bills and making one pot into two.

Divorce is  now much simpler and you can manage it  very easily yourself online through the Government website.https://www.gov.uk/divorce/file-for-divorce

Financial Disclosure

Identifying what is in the matrimonial pot is the first stage.  This  can be more complex than first thought. It is important you both know what each other has or had.

Once the pot is clear , it is then necessary to identify  ongoing needs. Are there any children, what are the relative  ages, the earning capacity, mortgage capacity?

Then the questions – how will equity be shared out? What is fair, what contributions have been made? how long has the relationship been? Is it possible to obtain a clean break and financial order?

We have experience in dealing with bot small and high worth applications for financial relief.

Watch out for high costs

While it is important to take legal advice to ensure you are making the right decisions, it is wise to have assistance in getting the evidence together economically.  This can be through mediation, or if that is not possible, through the process of financial disclosure which we can assist you with. This process is needed to obtain a financial order and clean break.

Costs are  front loaded and in the early stages as information must be shared. We can support you in this and save a great deal of fees in correspondence charges.  We can help you identify relevant and meaningful questions in the disclosure process.

if you feel you need a barrister, we can assist in finding a public access barrister should you wish to have professional legal advice. Alternatively we can assist you through the whole process to obtain a clean break and financial order.
